Welcome to the Office Pod Company. These Terms and Conditions govern your use of our website and the purchase of our acoustic pods. By accessing our site, you agree to comply with these terms, which are tailored to the regulatory environment of South Africa.
1. General
1.1 These Terms & Conditions govern all quotations, orders, and agreements between The Office Pod Company (Pty) Ltd (“the Company”) and the Client.
1.2 By accepting a quotation or placing an order, the Client agrees to be bound by these Terms & Conditions.
1.3 Any variation to these Terms must be agreed to in writing by the Company.
2. Pricing & Scope
2.1 All quotations are valid for 30 days unless otherwise stated.
2.2 Prices exclude VAT and additional delivery or installation costs unless stated.
2.3 Pricing is based on available information and may change if scope or conditions change.
2.4 Pricing excludes site conditions such as electrical, HVAC, or obstructions unless included.
2.5 The Company is not responsible for electrical or data installation.
2.6 Site inspections may incur additional costs.
2.7 Unforeseen site conditions may result in additional charges.
2.8 Pods accommodate minor floor uneven variation.
2.9 Dimensions are subject to manufacturing tolerances.
3. Payment Terms
3.1 50% deposit required; balance due before delivery unless agreed otherwise.
3.2 Payments must be made in ZAR without deductions.
3.3 Interest may be charged on overdue amounts.
3.4 Payments may be allocated at the Company’s discretion.
3.5 Ownership remains with the Company until paid in full.
4. Manufacturing & Lead Times
4.1 Lead times are estimates.
4.2 The Company is not liable for delays outside its control.
4.3 Production starts after final approval and deposit.
5. Delivery & Installation
5.1 Delivery dates are estimates.
5.2 The Client must ensure site readiness, access, and suitable conditions.
5.3 Delays due to site issues are for the Client’s account.
5.4 Installation time may vary.
6. Single Continuous Installation Visit
6.1 Installation is based on one continuous site visit (“Installation Period”).
6.2 The Client must ensure the site is fully prepared, cleared, and accessible prior to installation.
6.3 All required services must be available and operational where applicable.
6.4 No other trades or activities may interfere with installation.
6.5 If installation cannot be completed due to Client-side or third-party delays, the Company may demobilise.
7. Return Visit Charges
7.1 Where additional visits are required due to reasons beyond the Company’s control, additional charges will apply.
7.2 Charges may include labour, transport, accommodation, and rescheduling costs.
7.3 A minimum return visit fee may be applied.
8. Programme Impact
8.1 Installation durations are based on uninterrupted working time.
8.2 Any interruption will extend the programme.
8.3 The Company is not liable for failure to meet original timelines where delays are outside its control.
9. Warranty & Guarantees
9.1 Warranty Periods
The Company warrants that its products are free from defects in materials and workmanship under normal commercial use for the following periods:
- Pod structure and core components: 5 years
- Electrical, ventilation, and mechanical components: 12 months
- Soft finishes (including fabrics, PET panels, and upholstery): 2 years
- Custom-designed or modified products: 12 months
9.2 Warranty Conditions
This warranty is valid only where:
- The product has been installed and used in accordance with the Company’s guidelines
- Proof of purchase is provided
- The product has not been misused, altered, or subjected to abnormal conditions
- No repairs, modifications, or alterations have been carried out by unauthorised parties
- The product has been maintained in accordance with the Company’s care and maintenance guidelines
9.3 Claims Procedure
To make a warranty claim, the Client must:
- Notify the Company in writing within a reasonable time of discovering the issue
- Provide supporting evidence, including photographs and/or video
- Allow the Company reasonable access to inspect the product (either remotely or on-site)
The Company reserves the right to determine whether the issue falls within the scope of the warranty.
9.4 Scope of Warranty
The Company will, at its sole discretion:
- Repair the defective product or component, or
- Replace the defective product or component
The warranty does not include:
- Removal and reinstallation costs
- Transport, travel, or access costs
- Any costs associated with third-party contractors
Unless expressly agreed in writing.
9.5 Exclusions
This warranty does not cover:
- Fair wear and tear
- Misuse, neglect, or improper use
- Damage caused by other contractors, trades, or third parties
- Damage caused during relocation or reinstallation not carried out by the Company
- Environmental conditions (including humidity, temperature, UV exposure, or corrosion)
- Colour fading, natural ageing, or material variation
- Fabric staining, abrasion, or damage caused by incorrect cleaning methods
- Electrical issues caused by external power supply or building infrastructure
9.6 Commercial Use Definition
“Normal commercial use” is defined as use within a standard office environment operating up to a single shift (approximately 8–10 hours per day).
Use beyond this (including 24-hour operation, high-frequency usage environments, or public access installations) may invalidate or reduce warranty coverage unless agreed in writing.
9.7 Limitation of Liability
The Company shall not be liable for:
- Any indirect, incidental, or consequential loss
- Loss of business, revenue, or productivity
- Any costs arising from downtime or inability to use the product
9.8 Warranty Limitation
This warranty:
- Applies only to the original purchaser
- Is non-transferable unless agreed in writing
- Is limited strictly to the terms outlined above
10. Materials & Finishes
10.1 Natural materials may vary.
10.2 Exact matching cannot be guaranteed.
11. Liability
11.1 Liability is limited to repair or replacement.
11.2 No liability for indirect or consequential loss.
12. Intellectual Property
12.1 All designs remain Company property.
12.2 No reproduction without consent.
13. Cancellations & Returns
13.1 Orders cannot be cancelled after production starts.
13.2 Pre-production cancellations may incur costs.
13.3 Custom products are non-returnable unless defective.
14. Governing Law
14.1 Governed by South African law.
14.2 Disputes fall under South African courts.
15. Acceptance
15.1 Acceptance of any order confirms agreement to these Terms.
